Averting the Lassa Fever Scare: Multifaceted Action Urgently Required

first_imgIn early March this year the National Public Health Institute of Liberia (NPHIL) reported the outbreak of Lassa fever in Montserrado and Nimba counties, claiming three lives. Immediately following this scary announcement, the Daily Observer, in an Editorial, called on the Liberian government to treat the resurgence of this deadly disease with urgency, in order to forestall its spread.The Editorial further disclosed that a total of 134 contacts had been identified in Montserrado County (105), Margibi, 25 and Nimba (4), including 37 health workers. The Editorial noted that since January 1 this year, a total of 28 suspected cases of Lassa fever have been reported across the country, including 12 deaths in Montserrado, Bong and Nimba counties.Now two more deaths from Lassa fever have been reported this week—both in Margibi County—from a highly authoritative source, the county’s Chief Medical Officer, Dr. Myer Chea Pajibo. The Liberia News Agency (LNA) reported that Dr. Pajibo made the announcement this Tuesday at a news conference at the C.H. Rennie Memorial Hospital in Kakata, the Margibi capital.The two confirmed cases, he said, had been identified on May 4 and 7, 2018 at the C.H. Rennie Hospital. But he declined to name the victims or their specific communities, though Dr. Pajibo did indicate that both victims came from Kakata, the county capital, and from Gibi, a mountainous region of the county. The Chief Medical Officer made another equally troubling revelation.The male victim and his wife had traveled to Toma in Bong County to the funeral of their grandchild “who had suddenly died from a fever of unknown origin.” Could the fever that killed their grandchild have also been Lassa fever? Too bad an autopsy on the child did not take place before burial, though it may not be too late.But surely this should lead Bong County authorities, beginning with their Chief Medical Officer and Phebe and C.B. Dunbar Hospitals to launch an immediate investigation into the nature of the fever that caused this child’s death, to authenticate whether or not it was Lassa fever, and also to test other children in the area to determine whether any of them may be afflicted with that or any other strange “fever”.On a broader perspective, we are again calling on the Liberian government, most especially the Ministry of Health and the NPHIL to institute a national ALERT initiative, to warn the public about the danger of Lassa fever and ALL that people can and must do vigorously to suppress the further spread of this virus. Part of the campaign should be to let the public know exactly where the disease comes from.Lassa fever is a viral hemorrhagic illness caused by a virus that is transmitted through contact with the urine or feces of infected rodents (rats) and through direct contact with body fluids of infected individuals. Hemorrhagic means a profuse discharge of blood vessel; bleeding or the abnormal flow of blood. And where do rats, roaches, mosquitos and other such dangerous creatures come from?They come from unattended garbage—huge dumpsites, mountains of which are found in Paynesville, especially the commercial Red Light district, stagnant water found in such places as the clogged drainages in Soniwehn in central Monrovia and elsewhere.We must here highly commend the new Mayor of Paynesville City, Madam Pam Belcher-Taylor, who shortly after taking office has already begun cleaning up the garbage from the city’s main thoroughfare, Tubman Boulevard, especially the filthy stockpiles found near Matilda Parker’s place of birth.We pray that Mayor Belcher-Taylor will go further and clean up the marketplaces where our market women, with their babies and other children must sell in filth; and also the piles of garbage leading to the Gobachop market and the long stretches of garbage behind the Police Station on Somalia Drive. We make the same plea to the Mayor of Monrovia, Jefferson Koijee, to clean up the nation’s capital—Soniwehn, Center Street, including the Palm Grove Cemetery, Waterside and the whole Bushrod Island vicinity.We make the same appeal to all of Liberia’s other mayors, especially those where the Lassa fever virus has been taking its deadly toll—in Kakata and other areas of Margibi County, Gbarnga and other parts of Bong County, Ganta, Sanniquellie and other parts of Nimba County.The Heath authorities, especially Minister Wilhelmina Jallah, should ever remember the urgent plea we made in a recent Editorial, to reactivate the Ministry’s Sanitation Division, so that they may undertake a vigorous campaign to ensure a clean Monrovia and all other cities around the country.The Health Minister and all government officials have definitely heard of the ancient dictum—“Cleanliness is next to godliness.” All of our doctors, nurses and paramedics and most people in Liberia have also heard that “Prevention is better than cure.”A vigorous sanitation campaign is a most critical part of PREVENTION!Share this:Click to share on Twitter (Opens in new window)Click to share on Facebook (Opens in new window)last_img read more

WOTUS debates continue in the legal system

first_imgShare Facebook Twitter Google + LinkedIn Pinterest In May 2015, the Obama EPA and Army Corp of Engineers issued a revised definition of “waters of the US.” That language has been discussed in this column on several occasions. Words, however, are rarely the culprit. That usually falls to aggressive interpretation and poor discretion by the enforcers of the rule. For instance, the EPA unsuccessfully attempted to regulate rain drops and puddles on a chicken farm as “waters of the US.” Ridiculous.The revised definition was widely criticized by farmers, builders and industry claiming the rule impermissibly allowed the EPA to regulate private land. The Trump Administration verbally opposed the definition, promising to repeal and replace it with a much narrower definition. As of Jan. 22, 2018, no action had been taken although an Executive Order was signed encouraging rule revision. Ever hear that not deciding is deciding?On that date, January 22, 2018, the US Supreme Court UNANIMOUSLY decided an important procedural issue in National Association of Manufacturers v. Department of Defense. Which court hears challenges to the meaning of “waters of the US”? All justices agreed that issues around the contentious waters of the US rule should be heard in federal district courts rather that appellate courts, even though it was not the most efficient use of judicial resources. Let that sink in. When is the last time all nine of the justices on the U.S. Supreme Court agreed about anything other than lunchtime? And why does this matter?Moreover, both the Trump and Obama Administrations had argued that Clean Water Act issues should be interpreted functionally rather than literally. Both strenuously advocated for hearings in appellate courts, not the district courts. When did the Trump and Obama Administrations ever agree on anything? Ever hear the old saying that politics makes for strange bedfellows?Justice Sonia Sotomayor wrote the opinion for the court and held that the text of the Clean Water Act trumps all of the government’s arguments in the long-running fight over which courts have jurisdiction over the Obama Administration contentious waters of the US rule. And district courts are the proper place.The choice of court — district not appellate — is significant because it affects the resources needed to litigate the merits of challenges, sets the Statute of Limitations for filing lawsuits and helps determine whether actions can be challenged in subsequent civil or criminal proceedings. District courts are also more tilted toward overturning government actions. Use of district courts will likely make litigation and suits challenging Clean Water Act regulations less orderly, as this option enables the practice of forum shopping (opting to file suit in a favorable district), as well as the possibility of conflicting rulings from district courts.The decision is especially relevant as the Sixth Circuit of Appeals had a stay/hold on implementing the Obama era definition of “waters of the US.” Enacted in 1948, but as amended in 1972, the Clean Water Act established a basic structure for regulating pollutant discharges into the waters of the U.S. The legislation gave the EPA the authority to implement pollution control programs such as setting wastewater standards for industry and regulating concentrated animal feeding operations.Since 1972, there has been much litigation about specifics of the Clean Water Act, some of it reaching the highest court. Most recently, in 2015, the revised definition of “waters of the US” had enraged many. The Obama administration sought to create a straightforward meaning, but critics felt it went too far and argued it was over-reaching.In the short time since the Supreme Court decision of Jan. 22, 2018, much has happened. The floodgates have opened, and many suits have already been filed in district courts all over the country.Ten days after the Supreme Court’s unanimous decision, the EPA issued the following statement. “The 2015 WOTUS” rule developed by the Obama Administration will not be applicable for the next two years, while we work through the process of providing long-term regulatory certainty across all 50 states about what waters are subject to federal regulation.”Stay tuned for how the EPA’s position impacts the pending litigation in district courts. There is no clear answer at the present time. At least we know where the question is to be heard — in any federal district court in the country — thanks to the recent unanimous Supreme Court decision. And different districts may reach different conclusions. This could get interesting. At least while the EPA and the Army Corp of Engineers are arguing about language they are not policing puddles.last_img read more

Address commonalities of problems before UCC: experts

first_imgPanaji: Experts on the subject offered diverse views on Uniform Civil Code (UCC) which proposes to replace personal laws based on customs and traditions in major communities in the country.At an Interactive Dialogue organised by Goa Study Group, in association with the International Centre Goa, former Union Minister for External Affairs and senior Congress leader Eduaro Faleiro suggested constitution of a consultative committee by the Centre. This committee, he said, could comprise of former Supreme Court and high court judges, mainly from the Muslim community, moderate religious scholars and Muslim women representatives who could suggest draft amendments to the present Muslim law, which could then be considered by Parliament.Controversial issueMr. Faleiro, who is also a lawyer with expertise in Portuguese Civil Code(PCC) still prevalent in this erstwhile Portuguese colony, termed the debate on a UCC as one of the most controversial issues in the Indian politics.“Article 44 of Constitution in Directive Principles says that the State shall endeavour to secure all citizens an Uniform Civil Code throughout India. Article 44 cannot contradict in any manner Article 25 of the Constitution on the Fundamental Right to Freedom of Religion,” he said at the interaction held over the weekend.The veteran Congressman recalled that the late Prime Minister Pandit Jawaharlal Nehru had supported the idea of an UCC but did not want it to be forced upon any community.Goa and UCC“It is said that Goa is the only State of India with an UCC. It is not true. The usages and customs of the Hindu and Muslim communities are safeguarded by the Civil Code operating in Goa.” Mr. Faleiro said.He added, “Catholic marriages in the church have civil effects automatically whilst in the other communities, the marriages have to be registered before the Civil Registrar. Adoptions are not permitted for Catholics whilst they are permitted for Hindus and Muslims,” He also said that there was an optional Special Marriage Act of 1954 and it was available to all Indian citizens irrespective of religion.Gender discriminationThe Principal of the city-based V. M. Salgaocar College of Law M. R. K. Prasad said UCC should be uniform across all communities and felt that first the commonality of the problems faced by all should be addressed.He said, “Uniform Civil Code may be required to stop gender discrimination. Whether it is Hindu law, Muslim law or Christian law, they are predominantly male-dominated.” Mr. Prasad added, “So equality should be brought first through a Uniform Civil Code as a model code. Let the people look at it, discuss, decide. May be it could be implemented through consensus in the course of time.”Member of the All India Muslim Personal Law Board Fakhira Ateeq said, “India is a multi-cultural, multi-lingual and multi-religious country, we simply cannot control a system which is tiny part of a religion. How can we manage uniform civil code in all religions.” She added, “Enforcing anything forcibly will result in devastating consequences. If there are problems in implementation and laws are misinterpreted then law cannot be blamed.”‘Unity in diversity’Ms. Ateeq said, “[The] Beauty of our country is unity in diversity. So all communities derive their personal laws based on their beliefs and faith. UCC will disturb those crucial fabrics. Central Government has come up with an idea of UCC to ensure that we are governed by a law. She added, “”According to Indian legal system in the procedural laws, there are criminal laws and civil laws. Criminal laws are already being applied uniformly. Even major part of civil laws apply uniformly, except family laws. Question is which kind of uniformity our current government is looking at? We do not have a common God, worship system, rituals, or festivals. How can be family laws common?”In Goa, the prevailing PCC under which registration of marriage is mandatory, among others, ensures financial empowerment of a married woman and progeny of the spouses. Flood waters recede in NE, 6 lakh people affected

first_imgWater level in the flood-affected areas of northeastern States receded on Friday but more than 6 lakh people continued to be affected.There were no reports of any casualty on Friday after rain-induced flash floods and landslides killed 12 people across Assam, Manipur and Tripura over the past two days. Assam has been the worst affected.Seven districtsOfficials of Assam State Disaster Management Authority (ASDMA) said the first wave of flood in the State affected seven districts, including all three – Cachar, Hailakandi and Karimganj – in southern Assam’s Barak Valley.“In three days, 668 villages have been submerged in seven districts and 3,86,570 people have been affected. While 325 houses have been damaged in flood, 136 houses have been destroyed in the hills of Dima Hasao district,” an ASDMA officer said.Five rivers, including the Barak and the Kushiyara, were flowing above the danger level.National Disaster Response Force, State Disaster Response Force and Assam Rifles teams have rescued 471 people, while 67,175 people have taken refuge in 162 relief camps, officials said.In Manipur, more than 1, 50,000 people have been affected by flood in the Imphal Valley, while an arterial highway remained cut off because of landslide. Ferry services in the Barak Valley and train services on the Lumding-Badarpur hill section in Assam has been suspended, affecting train services to Tripura.A total of 430 persons have so far been evacuated from flood-affected areas of Manipur and more than 950 rescued in Tripura by Assam Rifles and Army personnel, a Defence statement said on Friday.More than 2,000 people are being sheltered at relief camps in Tripura.Landslides have been reported from Arunachal Pradesh and Meghalaya too, but officials said there have been no loss of human lives.(With IANS inputs)last_img read more

The party on Saturday announced that it will hold ‘Lalu Sandesh Chaupal’ in every panchayat of Bihar where letters to the voters, including the one Mr. Prasad wrote before he was sent to jail, will be read out. “We will let our voters know how the CBI and the governments at the Centre and the State connived to falsely implicate Lalu Prasad in cases and sent him to jail,” State RJD president Ram Chandra Purve told presspersons after the party’s state executive committee meeting concluded in Patna. The third letter would have suggestions made by senior leader Raghuvansh Prasad Singh.
